Publication Agreement

Contributors (“Contributors”) who publish works (“Works”) on the Digital Law Asia platform (“Platform”) agree to the following:

I. Contributor’s Grant of Rights.

1. The Contributor grants to the Platform a perpetual, royalty-free, worldwide, exclusive right and license to publish the Work on the Platform.

2. The Contributor authorizes the editors of the Platform to edit the Work prior to its publication on the Platform, but the Work shall not be published unless the version to be published is acceptable to both the Contributor and the editors of the Platform.

3.The Contributor grants to the Platform the right to prepare or have prepared translations of the Work into any and all languages.

4. The Contributor grants the above rights on an exclusive basis, and without claim of royalties or other compensation.

II. Contributor’s Reservation of Rights.

The Contributor retains the following rights not expressly granted to the Platform in Section I:

1. The Contributor shall retain ownership of copyright in the Work.

2. The Contributor shall have the unrestricted right to republish the Work (including on institutional or other repositories); provided, in all cases, that the publication identifies the Platform and provides a link to the original article on the Platform.

3. The Contributor retains the right to reproduce, distribute, and display the Work, and to authorize others to reproduce, distribute, and display the Work, in any format, provided that (i) the reproduction identifies the Contributor and the Work’s full title; and (ii) the reproduction identifies the Platform and provides a link to the original article on the Platform.

4. The Contributor retains the right to authorize third parties to reproduce, display, or distribute the Work in any format, in full or in part, as part of an anthology, textbook, casebook or other collective work intended for scholarly or educational use.

5. The Contributor retains the right to include the Work, in full or in part, or an adaptation of the Work, in full or in part, in another work of which the Contributor is the sole or joint author, consistent with standard academic practice, provided that such work identifies the Platform and provides a link to the original article on the Platform.

III. Contributor’s Representations and Warranties.

1. The Contributor represents and warrants that the Contributor (i) is the sole author of the Work; (ii) has full power and authority to enter into this agreement and to grant to the Platform the rights and licenses described in Section I; and (iii) has not previously granted or otherwise conveyed any such rights or licenses to any other person or entity.

2. The Contributor represents and warrants that publication of the Work in accordance with this agreement will not violate or infringe any copyright, other intellectual property right, or proprietary or personal right of any person or entity, and that the necessary written permissions have been obtained for inclusion in the Work of any material that is not the Contributor’s original work and the use of which is not otherwise legally permissible under the doctrine of fair use or another limitation or exception to copyright.

3. The Contributor represents and warrants that the Work has not been previously published in the same or substantially the same form elsewhere.

Open Access Statement

Digital Law Asia’s content is open access and published under the Attribution-NonCommercial-ShareAlike 4.0 International (CC BY-NC-SA 4.0) license. This license allows reusers to distribute, remix, adapt, and build upon the material in any medium or format for noncommercial purposes only, and only so long as attribution is given to the creator. If you remix, adapt, or build upon the material, you must license the modified material under identical terms.

Authors retain the copyright to their publications as stated in the Publication Agreement. The Platform does not charge any publication fees. 

Quality Control

All submissions to the Platform undergo an editorial review process to ensure academic integrity and relevance to the field. Reviews are not anonymous. The Platform requests that authors give credit to the original sources of text, ideas, and pictures. All references, quotations, and citations must be appropriately documented in endnotes. Our editors routinely conduct similarity reports using Turnitin to inform publishing decisions.
